So affected areas are: · Section 1, Township 10, Range 8 West · Section 12, Township 10, Range 8 West On Wednesday, May 29, 2002, Robert Nusz called the law office of Attorney Kyle Goerke, Watonga, Ok. and spoke with his secretary Trisha and his wife Mary Francis Goerke about the mineral acres that were sold at auction to Mr. Tom Mahaffey on May 24, 2002. Legal description follows: ALL OF GRANTOR'S UNDIVIDED FRACTIONAL MINERAL INTEREST IN AND TO: · Lot ONE (1) of Section Twelve (12), Township Ten (10) North, Range Eight (8) West, Canadian County, Oklahoma, and · Lot Two (2), and S/2 NE/4 and Lots Three (3) and Four (4) and SE/4 NW/4 and · Lots Six (6) and Seven (7) and Eight (8) and the NE/4 SE/4 of Section 1, 10N, 8W · Lot One (1) in Section 12, all in 10N-8W. 3.375375 Containing approximately 34 Mineral Acres (MOL) for a price of $450.00 per mineral acre. This total comes from the Land Title research done by Mr. John Oler, Landman, (580) 623-8527 as contracted for research by Anna L. Thornton, Trust. This can be broke down as the following: · Anna purchased 408 surface acres and 204 Mineral acres, this area. Total: 204 mol mineral acres · Anna sold off 10 acres ?, then later bought them back Total: 214 mol mineral acres · Anna sold off 160 acres Total: 54 mol mineral acres · Anna deeded 10 acres to Roy Nusz Total: 44 mol mineral acres · Anna deeded 10 acres to Mary Ramey Total: 34 mol mineral acres Section 1, 10n 8w 107.9 net acres 1 2 3 4 6 7 8, Due to legal document that was found by Bo Quillen, Anna L. (Edwards-Dillard-Thornton) owned 557 acres and not 408 acres in these two sections. This was on a document recorded on January 2, 1985, a Stipulation of Cross Conveyance, signed by all owners, that there were 557 acres not 408. Now if you do the math of 557 Net surface acres, with ½ of the total area being mineral acres, that would give 278.5 net mineral acres to Anna L. Thornton. Taking into consideration that she sold off 160 net mineral acres, that would give Anna a total of 118.5 net mineral acres. Now remove the 10 mineral acres given to Roy Nusz, that would total 108.5 net mineral acres, now remove the 10 mineral acres that were given to Mary Ramey, that would give a final prior to sale date of 98.5 net mineral acres. Remove 34 Net mineral acres sold at sale, should leave a total of 64.5 net mineral acres. 557 net acres 279 net mineral -160 sold =119 -10 -10 99 -34 65 Mineral acres left
